金沢大学人間社会研究域法学系<br />本研究課題は，滋賀秀三氏による唐律疏議現代語訳の試みを継承し，唐断獄律の現代語訳を作成するとともに，そこから得られた唐代裁判制度に関する知見を各研究分担者が専門とする時代の裁判制度と比較検討することを通じて，唐代裁判制度の再検討を試みるものである。4年間に及ぶ研究活動の結果、断獄律全34条の翻訳を完了し公表するとともに、断獄律16条の立法趣旨や断獄律20条に見える「比附」の性格など、唐代裁判制度をめぐるいくつかの重要な問題を … 明らかにすることができた。<br />This research aims to translate "Tanglue-shuyi" or "Tang penal code and commentary" into Japanese, which was originally the work Professor Shuzo Shiga set about, and to study Tang judicial system through comparing it with judicial systems in other dynasties which research members are majoring in. As the result of our research , we have accomplished the translation of whole articles in Duanyu-lue, and have cleared some important points concerning judicial systems in Tang dynasty, such as the legislative purpose of Duanyu-lue section 16, and the meaning of Bifu in Duanyu-lue section 20.<br />研究課題/領域番号:22530004, 研究期間(年度):2010-04-01 – 2014-03-31 続きを見る
